Terms of Service

These Terms of Service ("Terms") are an agreement between you ("you", "Customer") and Twing Data, Inc. ("Twing Data", "we"). Twing.AI (the "Service") is a product of Twing Data, Inc. By accessing our site or using the Service, you agree to these Terms.

Service Overview

Twing.AI provides AI infrastructure for Private Equity (PE) firms, including CRM integrations, document processing, analytics, and workflow automation. With your authorization, we may access metadata and content necessary to provide the Service (e.g., CRM fields, document text, usage diagnostics). Beta features may be offered and can change or be removed at any time.

Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect information.

Your Account

You are responsible for maintaining the confidentiality of your account and for all activity under it. You may only register with a valid company email and must have authority to bind your organization to these Terms.

Access to Integrated Services

By connecting third‑party services (e.g., DealCloud, Salesforce, Affinity) or uploading content, you authorize Twing Data to access the data required to deliver the Service. We will not access data beyond what’s necessary.

Payments

Fees and billing terms depend on your selected plan or subscription. Trials are offered at our discretion and are subject to these Terms.

Cancellation and Termination

We may suspend or terminate access for non‑payment, violations of these Terms, or use that poses risk to us or others. You may terminate as permitted in your Order Form or agreement.

Customer Reference

You grant Twing Data permission to use your company name and logo as a customer reference. You can opt out anytime by emailing contact@twingdata.com.

Electronic Communications

You consent to receive communications electronically. Notices may be delivered via email or through the Service and satisfy legal requirements for written communication.

Third‑Party Links and Services

Linked sites and third‑party services are not under our control. We are not responsible for their content or practices. Where we rely on providers to deliver features, we may share information under appropriate safeguards.

Acceptable Use and IP

Do not misuse the Service, breach security, or infringe rights. We grant a limited, revocable license to use the Service as provided. You may not reverse engineer or exploit the Service or content except as permitted by law.

International Use

You are responsible for compliance with local laws when accessing the Service from outside the United States.

Indemnification

You agree to indemnify and hold Twing Data harmless from claims arising from your use of the Service, violation of these Terms, or infringement of third‑party rights, subject to applicable law.

Arbitration; Class Action Waiver

Except where prohibited, disputes will be resolved by binding arbitration on an individual basis. Class actions and collective proceedings are not permitted.

Disclaimer; Limitation of Liability

The Service is provided “as is” to the maximum extent permitted by law. Twing Data disclaims warranties and is not liable for indirect, incidental, consequential, special, or exemplary damages to the maximum extent permitted by law.

Governing Law; Termination

These Terms are governed by the laws of the State of Delaware, without regard to conflicts of law. We may suspend or terminate access at any time as permitted by these Terms and applicable law.

Changes to Terms

We may update these Terms and will post the updated version with a new “Last updated” date. Material changes may be communicated separately.
